This warranty is given by TerraForm. It is not given by Bunnings unless Bunnings expressly states otherwise. This does not affect any rights you may have against the place of purchase under the Australian Consumer Law.
1. Scope of This Warranty
TerraForm warrants that its edging products (Product) will be free from defects in materials and workmanship that result in structural failure or loss of intended function, when used in normal landscaping applications and installed and maintained in accordance with TerraForm instructions, for a period of 10 years from the date of purchase.
This 10-year period applies only to this voluntary structural warranty. Depending on the nature of the Product and the failure, you may still have rights under the Australian Consumer Law after this period.
If TerraForm accepts a valid claim under this warranty after reasonable assessment, TerraForm will, at its option, repair the Product, replace the Product or defective component with the same or a functionally equivalent product, or, if that is not reasonably available, refund the price paid for the defective Product or component.
2. What This Structural Warranty Does Not Cover
The exclusions below apply to this 10-year structural warranty only. They do not limit any rights or remedies you may have under the Australian Consumer Law.
- natural surface rust, patina development, colour variation, staining or other cosmetic changes that do not affect structural integrity or intended function, including where the Product is designed to develop a natural patina over time
- normal wear and tear
- improper installation, handling, storage, modification, repair, use of non-approved components, or failure to follow TerraForm installation instructions
- damage caused by impact, excessive loads, vehicle traffic, abuse, misuse, or use outside normal landscaping applications
- site conditions including poor drainage, corrosive soils, ground movement, prolonged water pooling, or similar adverse conditions
- exposure to fertilisers, salts, pool chemicals, or other corrosive substances
- coastal or high-salinity environments, unless TerraForm has expressly stated in writing that the Product is suitable for that environment
- storm, flood, fire, extreme weather, or other events outside TerraForm’s reasonable control
- damage caused by components, fixings, or workmanship not supplied by TerraForm
3. How to Make a Claim
To make a claim under this warranty, contact TerraForm within a reasonable time after becoming aware of the issue and before the end of the 10-year warranty period.
Please provide:
- proof of purchase, such as a receipt or tax invoice
- your name, phone number, email address and delivery address
- product details, quantity and place of purchase
- a description of the issue and when it first became apparent
- photographs and, where relevant, installation or site details
Claims may be made by email to contact@terraformedging.com, by phone on 1800 383 001, or by post to 6-12 Activity Street, Acacia Ridge QLD 4110, Australia.
TerraForm may request additional information, photographs, inspection of the Product, or return of the Product or a sample, so that it can reasonably assess the claim. If the Product is large, heavy or difficult to remove, contact TerraForm first so that reasonable arrangements can be discussed.
Unless TerraForm agrees otherwise or the law requires otherwise, you are responsible for the ordinary costs of making a claim, including uninstalling and reinstalling the Product. If TerraForm asks you to return the Product and the claim is accepted, TerraForm will reimburse reasonable postage or transport costs you have reasonably incurred in making the claim. Nothing in this warranty limits any right you may have under the Australian Consumer Law to recover reasonable return costs or reasonably foreseeable loss or damage where applicable.
4. Australian Consumer Law
This warranty is provided in addition to other rights and remedies you may have under the Australian Consumer Law and any other law that cannot be excluded.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in this warranty requires you to claim only through TerraForm. You may also seek a remedy from the seller, including Bunnings, where the Australian Consumer Law applies.
Under the Australian Consumer Law, goods are expected to be of acceptable quality, which includes being safe, durable, free from defects, and having an acceptable appearance and finish.
5. Limitation Consistent With Law
Except for rights and remedies that cannot be excluded by law, TerraForm’s obligations under this 10-year structural warranty are limited to the remedies set out in section 1. Nothing in this document excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law, including rights to compensation for reasonably foreseeable loss or damage.
